2006 DOT test results are published and our NXT -05 passed again with flying colors. You can get a copy of the test data for all helmets tested at FMVSS 218 Helmet Test Data for FY 2006.
This means we make the smallest, lightest helmet that meets DOT certification and stays well below the 300G limit of ASTM, SNELL and all other helmet standards.
In 2005 DOT tested NexL®'s NXT™ -05 model at UST and found some penetration failures and opened Compliance Investigation CI-218-040430. NexL® as part of it's compliance program had tested 72 NXT™ helmets to FMVSS 218 with no penetration failures.
NexL® met with DOT personnel at UST and reviewed the DOT failures. This review was followed by a complete test cycle of NXT™ -05 helmets in Small, Medium and Large configurations. Initially 8 helmets were tested and NexL® noted UST failures to conform with FMVSS 218 and test procedure TP-218.
UST corrected the conformance discrepancies and restarted and certified 15 NXT™ -05 helmets, 5 each in Small, Medium and Large. NexL® subsequently filed a report with DOT in which we noted the following:
• Noncompliances found in prior UST testing.
• Corrective action taken by UST.
• 2005 FMVSS 218 certification of our NXT™ -05 helmets by UST.
DOT would not revise their 2005 documents but they did send us the following letter which confirms that they had closed their investigation.

WHAT WE WILL DO
NexL® Sports Products will rework all NXT™ -01 and -02 half helmets at our facility in Watsonville, CA. We will add a lamination within the sides of the outer shell by the strap rivets to prevent side penetration, replace the helmet liner with a lower density liner to prevent the helmet exceeding 2.0 millisecond above 200g, add a loop to the outer strap capturing the "O" rings to prevent removal and slippage and install a new sectioned label inside.
This procedure will be performed at no charge for original retail owners, there is a nominal $15.00 charge for shipping, email for an RMA number so you can return your helmets to us to be upgraded within 30 days.
For non original retail owners there is a $30.00 charge including return shipping.
Please note that no warranty coverage is extended to helmets that have been resold, abused, or modified, or improperly used, or handled contrary to our recommendations. Similarly excluded are claims arising from ordinary wear and tear, or from crashes or impacts, or from unintended uses.
WHAT YOU SHOULD DO
Please contact us as soon as possible to arrange for us to rework your helmet(s). The labor time necessary to perform these corrections is approximately 45 minutes. However, it may take a few days to receive, repair, and return your helmets
IDENTIFYING A REWORKED PRODUCT
All reworked helmets will have a loop in the strap capturing the "O" rings; a new warning label with a date code after 6/16/03 and the model number will change to -05.
This plan shall exclude reimbursement as to the following:
Costs incurred during the period and for conditions which would have been covered free of charge under NexL®'s one-year express limited warranty;
Costs incurred not related to the noncompliant conditions described in this Report; and
Costs not reasonably necessary to correct any of the noncompliant conditions described in this Notice.
